TERMS OF USE

1. Acceptance of Terms

By accessing or using the Bitgifts platform at Bitgifts.co ("Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our Platform.

2. Description of Service

Bitgifts provides a platform for creating, purchasing, and redeeming Bitcoin gift cards ("Bitgifts"). Our services include:

  • Bitcoin gift card creation and customization
  • Secure payment processing through Stripe
  • Email delivery of gift notifications
  • Bitcoin transfer services via Lightning Network
  • Administrative and partner management tools

3. Eligibility

3.1 Age Requirements

You must be at least 18 years old to use our Platform. By using our services, you represent that you meet this age requirement.

3.2 Jurisdictional Compliance

You must comply with all applicable laws and regulations in your jurisdiction regarding Bitcoin and cryptocurrency transactions. Use of our Platform may be restricted or prohibited in certain jurisdictions.

4. Account Registration and Security

4.1 Account Information

You are responsible for providing accurate and complete information during registration and maintaining the accuracy of your account information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms or suspicious activity.

5. BitGift Services

5.1 BitGift Creation and Purchase

  • Bitgifts are available in predetermined USD amounts
  • Bitcoin values are calculated using real-time market pricing from Coinranking API
  • Once purchased, Bitcoin amounts are locked regardless of subsequent price changes
  • All payments are processed securely through Stripe with a $2 service fee

5.2 BitGift Redemption

  • Bitgifts can be redeemed using the unique 12-character code or redemption URL
  • Recipients must provide a valid Bitcoin wallet address or Lightning Network information
  • Bitgifts do not expire and can be redeemed at any time
  • Bitcoin transfers are processed via Lightning Network through Lightspark

5.3 Transaction Limitations

  • Maximum transaction amounts may apply based on regulatory requirements
  • We reserve the right to implement additional verification for large transactions
  • Failed transactions will be automatically refunded according to our refund policy

6. Fees and Payments

6.1 Service Fees

  • A $2 service fee is charged on all BitGift purchases
  • Bitcoin network fees may apply for certain transfer types
  • All fees are clearly disclosed before transaction completion

6.2 Payment Processing

  • Payments are processed through Stripe in compliance with PCI standards
  • We do not store your payment card information
  • Failed payments may result in temporary account restrictions

6.3 Refunds

  • Refunds are generally not available once a BitGift has been delivered to the recipient
  • Refunds for technical failures or unauthorized transactions will be processed according to our refund policy
  • Dispute resolution for payment issues follows Stripe's standard procedures

7. Partner Program

7.1 Partner Accounts

  • Partners receive access to specialized tools for BitGift generation and management
  • Partner accounts operate on a pre-funded credit system
  • Partners may receive custom branding and webhook integration capabilities

7.2 Partner Responsibilities

  • Partners must comply with all applicable laws and regulations
  • Partners are responsible for their own customer relationships and support
  • Partners must maintain adequate balances for their BitGift operations

8. Intellectual Property

8.1 Platform Content

All content on the Platform, including text, graphics, logos, and software, is owned by Bitgifts or our licensors and is protected by intellectual property laws.

8.2 User Content

You retain ownership of content you submit to the Platform (such as personal messages) but grant us a license to use, store, and transmit such content as necessary to provide our services.

8.3 Prohibited Use

You may not copy, reproduce, modify, or create derivative works of our Platform without express written permission.

9. Prohibited Activities

9.1 Illegal Activities

You may not use our Platform for any illegal activities, including but not limited to:

  • Money laundering or terrorist financing
  • Tax evasion or fraud
  • Violation of sanctions or export controls
  • Any activity prohibited by applicable law

9.2 Platform Abuse

You may not:

  • Attempt to circumvent security measures or access restrictions
  • Use automated tools to access or interact with the Platform
  • Interfere with the proper functioning of the Platform
  • Impersonate others or provide false information

9.3 Bitcoin-Specific Restrictions

  • Do not use our Platform to facilitate transactions involving stolen or illicit Bitcoin
  • Comply with all applicable regulations regarding cryptocurrency transactions
  • Do not attempt to exploit Bitcoin price volatility through our Platform

10. Risk Disclosures

10.1 Bitcoin Volatility

Bitcoin prices are highly volatile and can fluctuate significantly. While BitGift Bitcoin amounts are locked at purchase, the underlying value may change dramatically.

10.2 Technical Risks

  • Bitcoin transactions are irreversible
  • Technical failures may result in delayed or failed transfers
  • Lightning Network and blockchain congestion may affect transaction times

10.3 Regulatory Risks

Cryptocurrency regulations are evolving and may affect the availability or legality of our services in your jurisdiction.

11. Disclaimers and Limitation of Liability

11.1 Service Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Bitgifts SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR DATA.

11.3 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless Bitgifts from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
